We wish to announce a significant legal victory in a high-stakes customs adjudication matter before the Principal Commissioner of Customs, ICD Patparganj, Delhi , where the department had raised a demand exceeding *₹22.40 Crores* along with interest and penalty.
Our client, a multinational company, was issued a Show Cause Notice alleging wrongful classification of imported telecom equipment and incorrect exemption benefit under Notification No. 57/2017-Customs.
Before the Ld. Principal Commissioner, we made detailed submissions establishing correct classification of the imported goods, rightful eligibility to exemption benefits, and exposed serious legal and factual gaps in the department’s case, including improper invocation of extended period and penalty provisions.
As a result of the efforts, the Adjudicating Authority completely dropped the demand, interest, and penalty.
